Financial Incentives for the

22% Cash Rebate

Of up to 22% of eligible Malta expenditure given to  qualifying productions once filming is complete.

Qualifying Productions: feature films, television productions, mini-series, animation and documentaries are all eligible for the incentives, as long as they are at least partially produced in Malta.

Procedure: to apply an application must be made to the Malta Film Commission, including a detailed projection of the Malta budget for the production and completion of the Cultural Test as included in the application form. Upon assessment, the Commission would grant a provisional approval within 3 weeks after receipt of the application.

The final approval would be granted upon review of a final application, including audited accounts and a detailed analysis of the production expenditure in Malta, after shooting is completed – with the rebate being given no later than 5 months from the date of receipt of the final application.

Qualifying Expenditure: covers expenditure incurred during production in Malta on EU services, for example:

EU below-the-line labour, accommodation, transportation equipment and hire, location fees, catering services, per diems, leasing of offices, computer equipment, props, property,  animals, equipment, vehicles, and boats. Other qualifying expenditure includes wardrobe rentals, courtesy payments, telecommunications, craft service, laundry and cleaning services and professional services.

All expenditure submitted should be net of V.A.T, currently 18%, which is fully refundable on all goods and services.

Tax Credits

Investment aid for audiovisual facilities is also available under the Malta Enterprise Act, which is offered in the form of tax credits to a qualifying company in respect to an initial investment project in relation to qualifying expenditure.

Value Added Tax, stands at 18% and is fully refundable to productions on all goods and services

5% Corporate Tax Rate – under Malta’s ordinary corporate tax rate, filmmakers have the possibility to produce and distribute audiovisual productions from Malta and pay the lowest corporate tax rates in the European Union.

Investment aid – is offered in the form of tax credits to a qualifying productions in regards to an initial investment project.

Co-Productions

Malta has been a member of the European Convention on Cinematographic Co-production since September 2001. The aims of this Convention are to promote the development of European multilateral cinematographic co-production, to safeguard creation and freedom of expression and defend the cultural diversity of the various European countries.

In order to obtain co-production status, the work must involve at least three co-producers, established in three different Member States, which have signed up to the Convention – this does not exclude the participation of one or more co-producers who are not established in such Member States is possible, provided that their total contribution does not exceed 30% of the total cost of the production.

The co-produced work must also meet the definition of a European cinematographic work set forth in Appendix II to the Convention.

Once these conditions have been fulfilled, the Convention assimilates all co-productions, which have been given the prior approval of the competent authorities of the Parties, with national films; i.e. they are entitled to the benefits granted to the latter.

The Convention also covers the following: the minimum and maximum proportions of contributions from each co-producer; the right of each co-producer to co-ownership of the original, the picture and the sound; the general balance of investments and compulsory artistic and technical participation; the measures to be taken by the Parties to facilitate the production and export of the cinematographic work and the right of each Party to demand a final version of the cinematographic work in one of the languages of that Party.

There are currently 35 states member to this Convention.

Malta also has a bi-lateral co-production treaty with Canada.

Investment Funds

As with all Malta Investment Funds, Malta offers a low tax, cost-effective and flexible environment to Media Funds Operators and investment advisers established in Europe and the US.

Malta investment funds are usually promoted to authorised or experienced investors and are not subject to any investment or borrowing restrictions.

The distribution of income of a scheme to foreign investors is not taxed in Malta. There are also no Maltese capital gains taxes imposed on the disposal of units in both prescribed and non-prescribed funds.

A PIF may be set up as an incorporated open or close-ended investment company (SICAV or INVCO respectively), a limited partnership or a unit trust. It is typically a non-retail fund which is not subject to any restrictions on its investment or borrowing powers.
